COZYLOW does not sell its customers’ personal data.

7.3 User rights

Under applicable legislation, users may, depending on the circumstances, have the following rights:

  • The right to access their personal data;

  • The right to rectification;

  • The right to erasure;

  • The right to restriction of processing;

  • The right to object;

  • The right to data portability where applicable;

  • The right to withdraw consent at any time where processing is based on consent;

  • The right to define instructions concerning the handling of their data after death under the conditions provided for by French law.

To exercise these rights, users may send a request to:

Proof of identity is not requested systematically. Where there is reasonable doubt as to the identity of the person making the request, COZYLOW may ask for additional information needed to verify their identity.

Users also have the right to lodge a complaint with the French data-protection authority, the Commission Nationale de l’Informatique et des Libertés (CNIL).

7.4 Recipients and transfers of data

Personal data may be shared with service providers and processors used by COZYLOW where their involvement is necessary for operation of the Website, payment processing, preparation and delivery of orders, customer support, hosting or technical services.

These providers are authorised to process personal data only within the scope of the services entrusted to them and in accordance with applicable legislation.

Where personal data may be transferred outside the European Economic Area, COZYLOW ensures that such transfers rely on a mechanism recognised by applicable law and are covered by appropriate safeguards.

COZYLOW takes reasonable technical and organisational measures to preserve the confidentiality and security of the data it processes.

8. Security and notification of personal-data breaches

COZYLOW implements appropriate technical and organisational measures intended to reduce the risks of loss, unauthorised access, disclosure, alteration or destruction of personal data.

However, no computer system or electronic means of transmission can guarantee absolute security.

In the event of a personal-data breach, COZYLOW will take the measures required under applicable law and, where required, notify the competent authority and/or affected individuals.

Personal data is not transferred or sold to third parties for their own independent commercial purposes.

In the event of a restructuring, merger, acquisition or sale of the business, certain data may be transferred to the acquiring entity in accordance with applicable law.

9. Hyperlinks and cookies

cozylow.fr may contain links to websites or services operated by third parties.

COZYLOW does not control these third-party websites and cannot be held responsible for their content, practices or privacy policies.

The Website may use cookies and similar technologies necessary for its operation and, subject to the user’s choices where consent is required, cookies used for purposes including audience measurement, personalisation or advertising.

Users can manage their cookie preferences through the consent-management tool available on the Website and, where applicable, through their browser settings.

Refusing certain non-essential cookies does not prevent access to the Website but may limit some features.

9.1 Cookies

A cookie is a small file stored on or read from a user’s device when they visit a website.

Cookies may, among other things, enable the shopping basket to function, remember certain preferences, help secure the Website or, where permitted, measure its use.

Retention periods and the way cookies are used depend on their purpose and the services concerned.

9.2 Measurement technologies and tags

COZYLOW may use technologies such as tags, pixels or measurement tools to obtain information about use of the Website and the effectiveness of certain activities.

Where the use of these technologies requires the user’s consent, they are activated only after that consent has been obtained.

The data that may be collected depends on the services used and may include information about the device, browser, interactions with the Website or IP address.

10. Governing law and dispute resolution

These terms are governed by French law, subject to any mandatory provisions that may apply to a consumer residing in another country.

In the event of a dispute, the Customer is invited to contact COZYLOW first in an attempt to reach an amicable solution.

If no amicable solution can be reached, consumers may exercise the remedies available to them in accordance with the applicable jurisdiction rules.

Nothing in these terms is intended to deprive consumers of the right to bring proceedings before the competent court in accordance with applicable law.

11. Right of withdrawal and 30-day returns policy

For distance contracts, where the statutory right of withdrawal applies, consumers benefit from the rights provided for under Articles L.221-18 et seq. of the French Consumer Code.

As a commercial extension, COZYLOW allows customers to change their mind and request a return for up to 30 days from receipt of the product, subject to the conditions set out in the returns policy.

This commercial extension does not in any way limit the rights consumers have under applicable law.

To request a return, the Customer must inform COZYLOW of their decision before the applicable deadline by means of a clear and unambiguous statement.

The request may in particular be sent by email to:

contact@cozylow.fr

The Customer must provide the information needed to identify the order so that the request can be processed.

A registered letter or copy of the invoice is not systematically required to exercise the statutory right of withdrawal.

After receiving the request, COZYLOW will provide the Customer with the instructions required to organise the return.

Unless COZYLOW specifically agrees to cover the return, the product must be sent to the address provided in the return instructions.

Return shipping costs are borne by the Customer when exercising the statutory right of withdrawal or using the commercial returns policy, unless otherwise stated or where the product received is defective, damaged, non-conforming or the result of an error attributable to COZYLOW.

Returned products must be adequately protected and in a condition that allows them to be inspected. The consumer remains responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the product.

Detailed return arrangements, particularly for bulky products, are set out in COZYLOW’s Returns & Refunds Policy.

Where the statutory right of withdrawal is exercised, refunds are made in accordance with the procedures and time limits prescribed by applicable law.

For returns made after the statutory withdrawal period but within COZYLOW’s commercial 30-day extension, the terms of the Returns & Refunds Policy apply.
